Discount Card Terms and Conditions

Shakhtar Academy Kraków × Agora Logistics. The Card gives eligible members of the Shakhtar Club a standing 10% discount on all Agora Logistics own services provided to consumers - on the terms described below.

The agoralogistics.pl website is operated by Agora Logistics sp. z o.o. These terms govern the use of the website and the contact form — please read them before sending an enquiry.

§ 1. The Organiser and the Programme

1. The organiser of the Shakhtar Academy Kraków Discount Card Programme (the "Programme") is AGORA LOGISTICS sp. z o.o., with its registered office at ul. Balickiej 100, 30-149 Kraków, KRS 0001052673, NIP 6762648990, REGON 526105944, e-mail: kontakt@agoragroup.info (the "Organiser").

2. The Programme is free of charge and applies until revoked. For as long as the Programme runs, the Card gives the Participant a standing 10% discount (the "Discount") on the terms set out in these Terms and Conditions.

3. Shakhtar Academy Kraków (the "Club") takes part in distributing the Cards, but is not the organiser of the Programme, a service provider or a party to contracts concluded with the Organiser, and is not liable for the Organiser's services.

§ 2. The Participant and the Card

1. A Participant may be an active member of the Club and their parent or legal guardian, using the services privately, as a consumer (the "Participant"). The Programme does not cover contracts connected with business or professional activity, or fleet or partner settlements.

2. The Card must be original, come from distribution by the Club or the Organiser and bear a legible, individual number. The Card number must not be removed, changed or transferred to another Card. The Card may be used only by a member of the Club and their parent or legal guardian. The Card must not be sold, copied or passed on to other people.

3. The Card, together with its legible number, must be presented before the price is agreed, an order is placed or a contract is concluded. The Discount is not applied retrospectively after a contract has been concluded, a service has been performed or a sales document has been issued.

4. Where there are justified doubts, the Organiser may demand current confirmation of membership or obtain from the Club confirmation of active membership and of the correctness of the Card number. The entitlement expires when membership is lost, when the number is cancelled because abuse has been established, or when the Programme ends.

§ 3. How the Discount is applied

1. The Discount is 10% of the gross price of each own service provided directly by the Organiser, as indicated to the Participant before the contract is concluded. Where a service is priced individually, the Discount is applied to the Organiser's remuneration stated in the accepted quotation.

2. The Discount covers only the Organiser's own remuneration for the service. It does not reduce amounts that are not the price of the Organiser's own service, in particular the value of:

a) vehicles, parts, accessories, fuels, fluids, consumables and other goods; where a service covers labour and materials, the Discount applies to the labour only;

b) refundable deposits, damages, contractual penalties and charges arising from damage to property or breach of contract - where these are due under the law and the contract;

c) official fees and other public-law charges, insurance premiums, third-party services, operator or app commissions, and other amounts passed on without the Organiser's margin.

3. The Discount cannot be combined with other discounts, promotions, packages or vouchers. If another reduction is available, the Participant chooses the more favourable offer. The Discount cannot reduce the price below zero.

4. The Discount cannot be exchanged for money, refunded or transferred. The amount after the Discount is rounded to whole grosze in accordance with standard mathematical rules.

§ 4. Availability of services and prevention of abuse

1. The Card does not book an appointment and does not guarantee the availability of a service or the conclusion of a contract. The current price list and the Organiser's relevant terms and conditions or contract apply to the service, without prejudice to the consumer rights arising from the law.

2. The Organiser may refuse to apply the Discount if the Card was not presented in time, is not original, has been altered or copied, its number is illegible, changed or cancelled, the entitlement cannot be confirmed, or the contract is of a business, fleet or partner nature.

3. Where abuse is reasonably suspected, the Organiser may withhold the Discount for the time needed to clarify the matter. Confirmed copying or passing of the Card to an unauthorised person, or the giving of false information, justifies loss of entitlement to the Programme.

§ 5. Complaints and personal data

1. A complaint concerning the Programme may be submitted to kontakt@agoragroup.info or by post to the Organiser's address. To allow the matter to be dealt with efficiently, it is worth giving the Card number, a description of what happened, your request and your contact details. The Organiser replies to a consumer within 14 days of receiving the complaint, on paper or another durable medium.

2. These Terms and Conditions do not limit the Participant's statutory rights, in particular the right to complain about a service.

3. The Programme does not require the Card to be registered. The controller of the data provided when verifying entitlement or handling a complaint is the Organiser. Data is processed in order to run the Programme (art. 6(1)(b) GDPR/RODO), to fulfil legal obligations (point (c)) and to prevent abuse and protect claims - as the Organiser's legitimate interests (point (f)). Recipients may be the Club - only to the extent necessary to confirm membership - IT providers, accountants, lawyers and authorised public bodies.

4. Data is kept for the time needed to run the Programme and then until the periods required by law or the limitation periods for claims expire. Providing data is voluntary, but may be necessary in order to verify entitlement or to consider a complaint. Depending on the basis of processing, the Participant has - as applicable - the right of access, rectification, erasure, restriction, portability and objection, and the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes UODO).

§ 6. Changes to and ending of the Programme

1. The Organiser may amend these Terms and Conditions only for an important reason: a change in the law or a decision of an authority, the need to prevent abuse or to ensure security, a technical or organisational change affecting the Programme, or the end of cooperation with the Club. The new wording will be published on the Programme page at least 14 days in advance. Changes do not apply retrospectively and do not affect the Discount for services already ordered.

2. The Organiser may end the Programme for an important reason, in particular the end of cooperation with the Club, ceasing the activity covered by the Programme, or a permanent inability to continue running the Programme for legal, economic, technical or organisational reasons. The notice will be published on the Programme page at least 30 days in advance. The Discount remains valid for services properly ordered before the end date.

3. The current Terms and Conditions are available free of charge at https://www.agoralogistics.pl/ in a form that allows them to be saved and reproduced. Matters not governed by these Terms and Conditions are subject to Polish law, and these Terms and Conditions do not exclude or limit mandatory consumer rights.
